Welcome to my Terms of Service page!

Last major update: 8/8/2023

I reserve the right to make minor updates to my terms without disclosing changes. All major changes that would directly effect current clients will always be discussed.

Please read through my terms carefully before approaching me for a commission! You can find my TOS broken down into 4 sections:

1. Copyright/Usage Policy

2. Commission Process

3. What I Accept

4. Refund Policy

By commissioning me you agree to all the terms listed below. Violation of any of these terms may result in termination of your commission, and potentially being blacklisted from future transactions.

1. Copyright/Usage Policy

I, the artist, hold all copyright to the produced artwork, not the commissioner, unless exclusive rights to the piece in question were purchased by the commissioner. The commission should only be used by myself and the commissioner. The commissioner must agree that they will not perform copyright infringement of the commissioned work.

The following is considered copyright infringement

-Reproducing/using my artwork commercially for economic profit. Making prints/stickers for personal use is allowed. If interested in purchasing commercial rights for my work, please reach out.

-Taking credit for my artwork or giving none at all

-Removing my watermark/signature

-Editing/altering the artwork itself without my permission (cropping is fine. For anything else just ask please!)

-Turning my work into a Non-fungible Token (NFT) or other crypto-related commerce.

All these actions are strictly prohibited and may result in immediate permanent blacklisting and legal action where applicable.

I reserve the right to post your commission anywhere online to promote my work or produce merchandise of your commission to sell (however, I always discuss this with the client beforehand). Message me if you would prefer your commission to be private. Keeping a commission completely private will incur a fee of no less than 75% of the commission price. If you’d like me to wait to post on a specific date, that can be done for free, and you may always remain anonymous for when the commission is posted.

2. Commission Process

I reserve the right to refuse any commission request for any reason.

How to Order

When my commissions are open, I will have 2 forms to fill out depending on your request (standard or reference sheet). Fill out the form with all the necessary information, and I will read through it to get you your quote of the price. You may contact me via Twitter, Furaffinity, Telegram, or email privately with questions at any time during this process. If I choose to accept your request, I will reach out to the contact you included on your form to confirm the price and details, and should you want to move forward, I will send you an invoice via Square.

Payment

Payment is to be made in USD through Square. As of 2023 I ONLY accept payments through Square. You don't need an account, you just need to provide an email, which the invoice will go directly to. If you attempt to send money to me outside of an invoice, I will promptly refund you. For me to begin working on your commission, I require the full amount paid up front unless otherwise discussed (in rare cases I may accept payment plans, but these must be agreed upon by both parties in advance).

The Process

Once I accept your request, I will begin your commission as soon as possible. Note that there may be others ahead of you in my queue. I always send a sketch for approval. Once the sketch is approved, I move on to finish the piece; the amount of WIPs provided going forward depend on the scope and complexity of the piece, and whether I need to clarify things with the client, but we can always discuss how many WIPs you would like to see during the process. Keep in mind the more WIPs you request, the longer your commission will take. For reference sheets and custom designs, there will be a near constant dialogue between me and the client, with WIPs provided at every stage of the piece. This is a part of why reference sheet commissions are especially time consuming, and it's extremely important that you be responsive throughout the process.

Messages checking up on progress from time to time is acceptable. It is requested that you do not send more than five of these messages a week. Any more may be considered harassment (see ‘What I Accept’). Projected turnaround time ranges are stated in the forms, and I will give you an ETA once we discuss your place in the queue (prior to invoicing). Keep in mind this is an estimate and is in no way a guarantee your commission will be finished then. I do accept hard deadline requests for an additional fee, but they must be made far in advance as indicated on the forms.

I will send you the full picture privately before uploading publicly. I can make small changes according to your requests, but bigger changes may result in being charged a small fee. The fee(s) varies with complexity of the requested changes. It may be waived if I made a mistake and missed a detail, but only if the mistake was made after the WIP approval process. Mistakes that could've been corrected during earlier phases of the piece are still subject to the fee. Once everything is to your liking, the final product will be uploaded publicly unless it was requested to be private.

Deadlines

As stated above, I only give out ETAs unless you request a hard deadline for the additional fee. Keep in mind that I won't always accept hard deadline requests if I don't feel it'll be possible to deliver. More information regarding the case of a hard deadline being missed is discussed in the "Refund Policy" section of this document.

3. What I Accept

This section will represent difficulties I am willing to tolerate, as well as what I am willing and not willing to draw.

I reserve the right to deny a commission for any reason. I reserve the right to run background checks on potential commissioners. Under no circumstances will I draw for the following people: The Furry Raiders, Alt-furry/Alt-right, Burned Furs, or hold beliefs in line with homophobia, transphobia, racism, sexism, ableism, or any other hateful beliefs, if you use any slurs (aside from reclaiming purposes) I will NOT accept your commission request. If you're into NFTs or any other crypto commerce, I will NOT accept your commission request. I also do NOT accept requests from pedophiles, zoophiles, or anyone who endorses or apologizes for those groups. Please respect my boundaries to turn down your request, or face immediate termination of your commission request and permanent blacklisting. I DO run background checks.

Harassment will result in the cancellation and refunding of your commission. Harassment includes but is not limited to;

-Asking about commission progress more than five times a week (and being aggressive)

-Speaking badly about myself and my business (critique is fine, insults are not)

-Consistently insulting me/being demanding during the process

I have a three strike rule. If you harass me more than three times, you will be blacklisted and will never be able to purchase any sort of art from myself, and I reserve the right to post a customer beware about you.

4. Refund Policy

The amount you will get back will entirely depend on the situation. Once your commission is accepted, for the period in which the turnaround time range covers, you're locked in and cannot request a refund, with the exception of emergencies of course. However, after that time has passed, you are entitled to a refund under any circumstance. You may cancel and request a full refund if I have made no progress on your commission during the turnaround time range stated in the forms.

You may get a partial refund (50%-75%) if I had only partially completed the commission, equal to that of what's incomplete. Full refunds of partially completed commissions can be worked out on a case-by-case basis. Refund requests for fully completed pieces are possible, albeit rare, and are worked out on a case-by-case basis in very specific situations.

In the case of an artist cancellation, you will be refunded in full regardless of the progress made on the commission, with the exception of TOS violations. However, TOS violators will still at least receive a partial refund.

For hard deadlines: If the hard deadline has passed, you will received the additional fee in full back, and will be entitled to cancel the commission. If no work has been done, you're entitled to a full refund, and exact refund amount for in progress pieces will be worked out on a case-by-case basis. You're also welcome to not cancel the commission and simply take the refunded fee, as well as the full artwork once completed.

In the case the commission is canceled and progress has been made, I reserve the right to recycle the unfinished progress for my personal work or YCHs. If you’d like to keep the unfinished work, AND you have paid for that portion of it (aka not full refund), please just ask me. Do not upload your unfinished commission without my explicit permission.

That's it! Thanks for reading through!

Now go get yourself something nice!
